Post-Conviction

Post-Conviction

Florida law allows for “post-conviction relief” proceedings for the time after appeals have run out. If successful, these can mean another chance in court, or even freedom for a person who was convicted of a crime. There are several grounds for post-conviction relief. The most well-known and common is “ineffective assistance of counsel.”

If it is shown that your lawyer was ineffective in representing you, and this affected the result in your case, you may be entitled to relief under the law. It is very difficult to have a conviction reversed. The law in this area is complicated. The government has some of its sharpest lawyers assigned to this work to make sure you or your loved one remains behind bars. When you go into battle against these attorneys, you should have someone on your side who knows how to fight for you.

Post conviction motions can also include motions to correct jail credit, motions to correct an illegal sentence, or motions for a new trial. Even if a person was convicted at trial, there is still hope for freedom.
